Welcome to small-pms. By registering for an account, using our application, or accessing our API, you agree to these Terms of Service. If you do not agree, do not use the software.

1. The Short Version (TL;DR)

small-pms is currently in active Beta. We are building and shipping fast, which means things might break, change, or go offline. We provide this tool to help you manage your short-term rentals, but we are not legally or financially responsible if something goes wrong. You use this software entirely at your own risk.

2. Beta Software Acknowledgment

You acknowledge and agree that small-pms is a Beta version.

• The service is highly dynamic, rapidly evolving, and subject to constant change.

• We may add, alter, or remove features, APIs, or integrations at any time without prior notice.

• The software may contain bugs, errors, or inaccuracies that could cause failures, including but not limited to: missed emails, sync failures, or data loss.

3. Disclaimer of Warranties ("As Is" Clause)

The service is provided strictly on an "AS IS" and "AS AVAILABLE" basis. We explicitly disclaim all warranties of any kind, whether express or implied. We do not guarantee that:

• The service will meet your specific requirements.

• The service will be uninterrupted, timely, secure, or completely error-free.

• Any errors in the software will be corrected immediately.

4. Absolute Limitation of Liability

To the maximum extent permitted by applicable law, small-pms (and its founders, employees, and partners) shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages. This includes, but is not limited to, damages for:

• Lost Revenue: Missed reservations, double bookings, or billing errors.

• Data Loss: Deleted guest data, wiped configuration settings, or lost pipelines.

• Reputation: Negative reviews from guests due to automated communication failures.

• Service Interruptions: Downtime caused by our servers, third-party providers (Stripe, Resend, Supabase), or cron job failures.

Your sole and exclusive remedy for any dissatisfaction with the service is to stop using it and cancel your subscription.

5. Your Responsibilities as a Host

• Backup Your Business: You are solely responsible for verifying your bookings, schedules, and financial transactions. You should not rely solely on small-pms as your only source of truth during this Beta phase.

• Guest Data (GDPR): You are the Data Controller of your guests' information. You are responsible for legally collecting their data and obtaining necessary consents before using our platform to email or process them.

• No Spamming: You agree not to use our automated messaging features to send spam, unsolicited marketing, or abusive content. We reserve the right to suspend your account immediately if our email provider flags your activity.

6. Modifications and Termination

We reserve the right to modify these Terms at any time. We also reserve the right to suspend or terminate your account at any time, for any reason, without notice or liability to you.

7. Governing Law

These Terms shall be governed by the laws of the Republic of Slovenia, without regard to its conflict of law provisions.
